Hiring a lawyer isn’t usually top of mind when you are looking to buy, sell, or refinance a home. But in most cases, you’ll need a lawyer to seal the deal. A real estate lawyer will take care of the legal work and make sure everything is above board which includes:
- Reviewing all legal documents, such as the Purchase and Sale Agreement and, in the case of a condo purchase, the Estoppel Certificate.
- Making sure that property taxes are up-to-date and that no claims are listed against the property.
- Holding funds in a trust account until all the terms and conditions are satisfied.
- Ensuring that there is a valid title and the seller’s mortgage (if applicable) will be paid out and taken off the title.
How do I choose a real estate lawyer?  
Finding a good real estate lawyer, especially one who doesn’t give you a lengthy to-do list, can make all the difference during an already busy time in your life. If you plan on hiring Litco Law, you will need to meet with us either virtually or in person to sign documents and provide the balance of your down payment at least three to five days before the possession date.
How can I best prepare for selling a home?  
Make sure you have an up-to-date Real Property Report before your property is sold and that your residency status for income tax purposes is sorted out long before you sell.
If you are selling as a non-resident of Canada, we recommend you speak with an accountant early in the process in order to avoid potential closing delays and holdbacks of the sale proceeds.
