Can I Sue for a Workplace Injury in Alberta? Here’s What You Need to Know

This is a great question, and it’s one we get asked all the time at Litco Law. You might expect the answer to be a resounding “yes,” but in Alberta, nearly all work-related injuries fall under the Workers’ Compensation Board (WCB). This means that in most cases, you won’t be able to sue your employer—unless your line of work is exempt from WCB (more on that below).

Can I Ever Sue for a Workplace Injury?

If you were injured by someone who isn’t covered by WCB—such as a driver who hits you while you’re working—you may still be able to sue them. However, when it comes to your employer, WCB generally provides coverage in place of legal action.

What Does WCB Cover?

If you’re injured at work, the WCB compensates you for work-related injuries or diseases. This may include:

  • Medical aid
  • Lost income while recovering
  • Rehabilitation support

The amount of compensation you receive depends on the severity of your injuries and whether you need time off work. To strengthen your claim, it’s important to keep detailed records of everything that happened, including your injuries and medical treatments.

Who Is Exempt from WCB in Alberta?

Not all employers and employees are covered by WCB. Some industries, such as optometry, massage therapy, and golf services, and others are exempt. If you’re unsure whether you’re covered, you can check with your employer or contact WCB directly.

When Should You Speak to a Lawyer?

If you’ve been injured at work and feel that you’re not receiving fair compensation from WCB, your workplace is exempt from WCB, or the other party involved isn’t covered by the Worker’s Compensation Board, it’s a good idea to speak to a lawyer.
